§ 29-4. Same—Fee; bond.

  • Any person desiring a license as a transient merchant shall, before receiving the same, pay to the city auditor such daily fee as established from time to time by resolution of the city council; provided, that if a complaint is made to the city auditor that any person doing business within the city is a transient merchant and that such person claims to be a permanent merchant, he shall be required, as a condition of transacting business in the city without the payment of the license fee provided for herein, to give a bond to the city to secure the payment of the state license provided by law and a license provided for herein in the event that he fails to become a permanent merchant under the terms of this chapter.

    Such bond shall be in the penal sum of five hundred dollars ($500.00), with sureties to be approved as to legality and form by the city attorney and as to sufficiency by the city auditor, and shall be enforced, in case of breach thereof, by the proper authorities of the city. Upon its collection, the amount of the state license fee shall be paid to the state treasurer and the remainder, so far as applicable, shall be paid into the treasury of the city.
